Reservations

All reservations require a 50% deposit of the entire rental stay and full payment must be completed 60 days prior to arrival. Guests must sign this agreement to complete a reservation. By signing this agreement, guest agree to cancellation policies and all other stipulations as stated on AR Los Cabos web site, brochures or any other promotional material for each individual property.

Security Deposit

All reservations to Private Villas and Condominiums require a Security Deposit. This deposit will be refund 20 days after departure and it will cover incidental charges for damages to the property, phone calls to cellular phones (the usage of VoIP lines are not considered), special cleaning, etc. Client will receive a notification of the amount that will be deducted of the deposit 10 days after departure.

Age Requirements

The minimum required age to make a reservation for most Resorts and Hotels is 21. For Private Villa or Condominium, client must be at least 28 years old to make the reservation through AR Los Cabos and must be at the Villa or Condominium during the rental time.

Rates

All rates are quoted in US dollars and are subject to change without notice. AR Los Cabos reserves the right to substitute similar accommodations, amenities or services requested by the client, and to make adjustments in prices if it is discovered that a specific price was shown or quoted incorrectly. AR Los Cabos will do their best to provide services or accommodations of equal standard and quality.

Refunds and Cancellations

All payments are final and non-refundable unless AR Los Cabos can re-rent the same property for the same period of time.

Cancellations are subject to a penalty fee of $250 in addition to:

- All changes are subject to a $50 fee.
- On holiday season there are no re-schedule or refunds regardless of re-rental.
- 120 - 90 days prior to arrival, we will refund 80% of the amount received
- 89 - 60 days prior to arrival, we will refund 50% of the amount received
- 59 - 0 days prior to arrival all reservations are NOT REFUNDABLE
- Cancellations must be sent by guest by fax or by email and must be confirmed by AR
- Refunds will be made in the next 10 days

Partial or pro-rated refunds are not available in cases of weather, health issues, poor travel conditions, lack of required travel documents or transportation delays. Prices does not include all expenses and any item that are not listed or mentioned in the confirmation letter, including: air fares, drinks, resort fees, laundry, special cleaning services, parking fees, gratuities, meals, travel insurance or any other insurance, phone calls or any other item that the client does of a personal nature.

Responsibility / Disclaimer

Neither the villa owners, AR Los Cabos or their representatives of the villa will be held responsible for injury, loss, or damage to any person or property of persons occupying the rental property. The rights, if any, of a person occupying the property, or invitees of such person, to assert a claim or seek recourse against any property owner, sales representatives, agents for any injury to the person or property of such person shall be governed by the laws of Baja California Sur, Mexico and determined exclusively in and by the courts of Baja California Sur, Mexico having proper jurisdiction. The property owners and/or their representatives shall under no circumstance be responsible for any disturbance or inconvenience to guests occupying the property, due to actions of its neighbors or surrounding areas. We the property owners cannot be held liable in the event of acts of God, omission of supplier, property owner, air carrier, ground transportation, household staff, who does not render service or accommodations

The undersigned hereby assumes all risk of damage to any and all personal property of Landlord and the undersigned, including household furniture and goods during such use and occupancy. The undersigned hereby assumes any and all risks associated with the foregoing and agrees to hold Landlord harmless from and indemnify Landlord against the same. Some activities that guests engage in are especially dangerous, and include motorcycle, scooter, and four-wheeler (ATV) rentals, horse-back riding, SCUBA diving, deep-sea fishing, golfing, pool and ocean swimming and surfing.

Each guest agrees that he/she is voluntarily participating in any and all activities, risks, and use of the accommodations, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss or theft of personal property

Guests shall be responsible for the conduct of any minors accompanying the guest or who shall be invited onto the property and shall hold the property owner harmless and indemnify the property owner from and against any damage or injury caused by such minor.

Mexican laws can be much more severe than the United States in regard to illegal drugs or prostitution. Any guests using or possessing illegal drugs or allowing prostitution on the rental property, will be removed immediately from the premises and the local authorities will be contacted. Any rent money, including deposits will be forfeited. These strict policies are for the protection of the guests and the property owners. It is understood that the undersigned is responsible for the actions of their guests and for seeing that all guests occupying a rental property have read and will abide by this rental agreement and the rules and policies set forth in the property rental's brochure or on its web site.

Pets

Under no circumstances will pets be permitted on either property.

Documentation

Confirmation letter will be released to the client as soon as AR Los Cabos receives the final payment for the reservation and services requested and the rental agreement form signed is received. AR Los Cabos will provide all documents by email or by fax.

Baggage

Neither AR Los Cabos, nor the selling agent shall be responsible for the damage, delay or loss of customer's luggage.

Important Travel Information to Los Cabos

Beginning January 23, 2007, documentation requirements for international air travel have changed due to new U.S. government regulations. The government requires using a passport, however other documents may also be acceptable depending upon your nationality. This change in international regulations comes from the Department of Homeland Security for the purposes of ensuring aviation safety and security. This change facilitates entry into, and exit from the United States for U.S. citizens, as well as foreign visitors. No refunds will be made to any person that could not enter to Mexico as a result of their failure to provide the necessary documentation. Driver's license is required to make car rental arrangements.
